The Duty to Obey the Law : Selected Philosophical Readings

Descripción

The question, "Why should I obey the law?" introduces a contemporary puzzle that is every bit sometime equally philosophy itself. The puzzle is especially troublesome if we recall of cases in which breaking the law is not otherwise wrongful, and in which the chances of getting caught are negligible. Philosophers from Socrates to H.L.A. Hart have struggled to requite reasoned back up to the idea that we do take a general moral duty to obey the law but, more than recently, the greater number of learned voices has expressed dubiety that at that place is any such duty, at least every bit traditionally conceived. The thought that there is no such duty poses a claiming to our ordinary agreement of political authority and its legitimacy. In what sense tin political officials take a correct to rule u.s.a. if in that location is no duty to obey the laws they lay downwardly? Some thinkers, last that a general duty to obey the law cannot be dedicated, have gone and then far every bit to embrace philosophical riot, the view that the land is necessarily illegitimate. Others fence that the duty to obey the law tin can be grounded on the thought of consent, or on fairness, or on other ideas, such as community.
